State Vs. Tc

TC was stopped for driving recklessly. He was taken out of the car for the purpose of issuing citations. While outside of the car, officers went into the car to get the license and registration. They then located contraband and TC was arrested and charged with Trafficking, a category A felony. Las Vegas criminal defense attorney Charles Goodwin raised several issues, including:

1. The State’s inability to prove that TC was in possession of the drugs;
2. Suppression issues under Arizona v. Gant

As a result, the State dropped the trafficking charges. TC was offered probation and accepted the negotiation.
